From Determining Capacity to Facilitating Competencies: A New Mediation Framework (Susan H. Crawford, Lewis Dabney, Judith M. Filner,Peter R.Maida)
What should mediators do if they suspect that disputants do not have the capacity to enter into the mediation process? Some argue that mediators can and should determine capacity. This article argues that when mediators determine capacity this limits disputant civil rights, reduces mediator effectiveness, and erodes fundamental principles of mediation.

Mediator Reflections on Practice: Connecting Select Demographics and Preferred Orientations (Margaret S. Herrman, Nancy L. Hollett, Dawn Goettler Eaker, Jerry Gale)
Mediators' orientations to mediation have been hypothesized to be related to a variety of factors. This article from the Mediator Skills Project examines the association between mediators' goals and orientations and mediators' sex, experience as a mediator, professional background, and context of mediation.

Metaphors are a powerful linguistic and conceptual tool, much more powerful than conflict managers often acknowledge. This article suggests that dominant metaphors in the field should be reviewed and that innovative metaphors that better capture the complexity of conflict be introduced in the teaching and practice of dispute resolution.

Most of the teaching and training models in the field are focused on third-party neutrals, not third parties acting as agents within a dispute. Although some of the training for neutrals can be useful to educating agents, it is not fully sufficient.
