목차
Proposed Structure: Part I - The Fundamentals of International Investment Law This first part will cover the fundamentals of international investment law with an interesting tweak: a well-balanced global vision. While addressing, for instance, the "national treatment standard", the author in charge will not only cover its main conceptual features and case law related developments, but also make sure its reception in other parts of the world is carefully assessed. In doing so, concepts are deeply questioned and put in perspective. Part II- Dispute Settlement In view of the current heated debate on dispute settlement and the many interesting cases and institutional evolutions, which relate to the same, we feel it is important to dedicate one special part of our Handbook to the settlement of investment disputes which includes conflict management and dispute prevention. Here again, our vision will be balanced and informed by the latest global developments while taking into account the history of case law and institutional building. Part III - New Trends and Challenges In a prospective manner, this part aims at covering some of the currently discussed trends and challenges in the same globally informed fashion. We will willingly not dedicate a special part to "regional trends " or "country based" analysis. As a matter of principle indeed, our approach is global and a sense of comparison or country based experience is embedded in each article. However, if a given country of region experiences new trends and challenges, which could further bring a meaningful experience to the global, we could address it separately. Such trends include the inclusion of bilateral investment court as an alternative to the existing investor-state dispute settlement system, liberalization, investment facilitation and connecting investment and incentives.
