안녕하세요. 김묘엽입니다.
여러분들은 자신을 위한 새로운 도전을 시작하고 계시는 분들이십니다. 저 또한 여러분과 함께 새로운 도전을 시작하고 있습니다.
새로운 도전은 불안감과 두려움을 극복하는 데서부터 시작합니다. 저의 경우에 새로운 도전을 함에 있어서 좋은 일과 고마운 인연들이 너무 많았습니다. 그 일이 있었기에 불안감과 두려움은 흥분과 쾌감으로 바뀔 수 있었습니다. 새로운 도전을 함에 있어서 순탄하지 못했던 순간들도 있었습니다. 이런 순간을 극복해 나가면서 불안감과 두려움을 통제할 수 있는 사람으로 성장해 나갈 수 있었습니다.
지금에서 돌아보면 좋은 일과 고마운 인연들, 그리고 순탄하지 못했던 순간들 모두 다 감사하고 고마운 것들이었습니다. 어느 하나 고맙지 않고 감사하지 않은 것이 없습니다. 매 순간에 일희일비(一喜一悲) 하는 것보다는 항상 최선을 다해서 자신에게 부끄럽지 않은 것이 중요하다는 것을 배우고 있습니다.
우리 함께 새로운 도전을 향해 나아갑시다.
이번 교재의 특징입니다.
1. 지금까지 출제되었던 산업인력 관리공단의 공법과 관련된 시험의 기출문제를 전부 분석했습니다. 그리고 시험에 나왔던 문구들을 중심으로 교재를 편찬했습니다.
2. 기존의 공법 교재와 달리 조문의 순서가 아닌 과정의 순서로 목차를 구성했습니다. 공법 공부의 시발점은 과정에 대한 대략적인 이해를 바탕으로 해서 이루어지기 때문입니다. 결국 우리 시험에 출제되는 문제들도 이런 논의의 결과물이고, 그렇기에 공법의 조문의 일관되지 못한 조문을 가지고는 출제자의 출제의도를 파악할 수도, 출제가 예상되는 것의 예측도 할 수가 없게 됩니다. 이 교재가 추구하는 바는 공부를 함과 동시에 출제자의 출제의도까지 함께 파악하자는 것입니다.
3. 이 교재는 순수하게 여러분들이 수험용으로 사용하실 수 있도록 학문적인 논의의 가치는 있으나 수험 문제로 출제되기 어려운 내용은 철저히 배제했습니다. 그리고 각종의 논문과 대법원 판례를 전부 찾아서 시험에 출제 가능한 부분만을 체계적으로 정리해 두었습니다.
4. 이 교재의 목차순서가 동일한 휴대용 요약서가 출간됩니다. 문제풀이 강의 때 요약서를 활용할 수 있도록 빠르게 출간하도록 하겠습니다. 기본서를 공부하시고 난 후에 요약서를 통해 빠른 정리를 하시는 것이 가장 좋은 방법입니다.
법을 공부하는 가장 큰 이유는 법적 분쟁을 해결하기 위한 것이 아닙니다.
법을 공부해서 나의 권리는 미리 지키고, 의무는 다하고, 그리고 예상되는 분쟁을 예방하고자 하는 것입니다. 또한 법 공부를 통해 감정적인 사고가 아닌 논리적이고 체계적인 사고를 하는 것도 중요한 목표입니다.
법은 원칙을 기본 필두로 해서 예외를 가지고 있습니다. 예외를 인정함에는 합리적인 논거와 타당성을 갖추게끔 되어 있습니다. 그리고 법은 우리에게 그에 상응하는 책임도 가르쳐 줍니다.
제 인생의 터닝 포인트(Turning Point)는 여러 번 있었습니다.
멘토를 만나서 세상을 살아가는 지혜를 얻었고, 법을 공부함으로써 체계적인 사고를 하게 되었고, 아내를 만나서 따스하고 온화한 마음을 가지게 되는 터닝 포인트를 가졌습니다. 열심히 공부하시는 여러분들을 보면서 더욱 열심히 살아야겠다는 의지의 터닝 포인트를 매일 가지게 됩니다.
